The National Construction Code (NCC) and its predecessor the Building Code of Australia (BCA) set the performance requirements for all buildings in Australia. For most projects, the structural system can be designed to comply with the deemed-to-satisfy provisions — the prescriptive solutions in the NCC that, if followed exactly, are taken to comply without further justification. But not every project fits neatly into a deemed-to-satisfy solution.
When a design uses an alternative structural system, an innovative building form, a non-standard material, or a performance solution — the building certifier requires a Technical Compliance Report prepared by a Registered Professional Engineer. This report must document the engineering rationale, demonstrate that the design meets the performance requirements of the NCC, and provide the certifier with the technical evidence they need to issue approval with confidence.

When technical compliance reports are needed
Technical Compliance Reports are required whenever a structural design cannot be assessed against the prescriptive deemed-to-satisfy provisions of the NCC. The following are the most common scenarios in which our reports are prepared.
Alternative Structural Solutions
An alternative solution is a structural design that departs from the prescriptive deemed-to-satisfy provisions but still achieves the performance requirements of the NCC. Common examples include engineered mass timber systems, innovative steel connections that differ from standard AS 4100 connection configurations, composite structural systems, and structures with unusual geometry or load paths. A Technical Compliance Report documents the alternative solution, the engineering analysis that demonstrates compliance, and the professional endorsement of the Registered Professional Engineer who has assessed it.
Performance Solutions under NCC
The NCC explicitly allows performance solutions as a compliance pathway — provided the solution can be demonstrated to meet the performance requirements of the relevant NCC provision. For structural performance solutions, this requires an engineering analysis that demonstrates the structure can resist the design actions specified in AS/NZS 1170 Structural Actions for the design life and building class. Our Technical Compliance Reports document the performance solution in the format required by the NCC, including a clear statement of the performance requirement being addressed, the evidence of suitability, and the professional assessment.
Unique or Complex Building Forms
Architecturally expressive buildings — with cantilevered elements, large column-free spans, irregular plan geometry, curved or sloped structural members, or load paths that cannot be assessed by simple hand calculation — require a technical compliance report that documents the analysis methodology and demonstrates that the design meets the NCC structural performance requirements. We use finite element analysis, advanced structural modelling, and engineering judgement to assess complex structures, and document the methodology in a form that a building certifier can review and accept with confidence.
Existing Building NCC Assessment
When an existing building undergoes a change of use, a significant addition, or a renovation that triggers building code assessment, the certifier may require a Technical Compliance Report that documents the structural adequacy of the existing building for the new use and the new loads. This is particularly common for heritage buildings, industrial buildings being converted to residential or commercial use, and older structures where documentation is incomplete. Our reports assess the existing structure against current NCC requirements and document a clear compliance pathway — or identify the structural upgrades required.

Deemed-to-satisfy vs performance solutions — what certifiers need
Deemed-to-satisfy provisions: the standard pathway
The NCC sets out deemed-to-satisfy (DTS) provisions for structural design — prescriptive rules that, if followed, are taken to satisfy the performance requirements without further justification. For structural design, the DTS provisions typically reference the Australian Standards: AS/NZS 1170 for structural actions, AS 3600 for concrete, AS 4100 for steel, AS 1720 for timber, and so on. If a structural design follows these standards, it satisfies the NCC — and no technical compliance report is needed beyond the standard structural engineering certification.
Most residential and commercial construction in NSW follows the DTS pathway. The engineering documentation — drawings, specifications, and calculations — demonstrates compliance with the relevant standards, and the structural engineer's Section 6.2 certificate confirms that compliance. This is the fastest and lowest-cost compliance pathway, and it is the appropriate pathway for the vast majority of projects.
When is an alternative solution the right choice?
An alternative solution is appropriate when the DTS provisions would prevent the design intent from being realised — for example, when an architectural design requires a structural system that the prescriptive standards do not address, or when the DTS provisions would result in an unnecessarily conservative or expensive structural solution. Alternative solutions can also be the right choice when the existing building's structural system is not code-compliant under current standards but demonstrably adequate for the building's intended use — a common situation in adaptive reuse projects.
What certifiers need in a technical compliance report
Building certifiers are not structural engineers. They rely on the Technical Compliance Report to understand what has been assessed, how it has been assessed, what the conclusion is, and why the engineer is confident in that conclusion. A report that is dense with equations but light on explanation does not serve the certifier — it leaves them with unanswered questions and a reluctance to issue approval.
A well-structured Technical Compliance Report includes: a clear statement of the NCC provisions being addressed; a description of the structural system and why a DTS approach is not applicable or appropriate; the analysis methodology and the software or calculation methods used; the results of the analysis and what they mean; a conclusion that explicitly states that the design meets the NCC performance requirements; and the professional endorsement of the Registered Professional Engineer. It should be written so that a competent professional who is not a structural engineer can follow the logic and reach the same conclusion.

For projects where a Technical Compliance Report is required as a condition of Development Consent — often imposed because the certifier or council assessor identified a potential non-compliance during the DA assessment — we review the DA conditions carefully, engage with the certifier to understand exactly what evidence they require, and prepare a targeted report that satisfies those requirements efficiently.
