The NSW Civil & Administrative Tribunal hears a significant volume of residential building disputes, including defect claims under the Home Building Act 1989. Expert witnesses appearing before NCAT are required to comply with NCAT's Expert Witness Code of Conduct, which imposes duties of independence, impartiality and disclosure that ordinary engineering reports do not address. Our reports include a declaration of compliance with the Code, identify the factual basis for our opinions, disclose the assumptions underlying our analysis, and draw a clear line between matters of fact and matters of professional opinion.

For District Court and Supreme Court matters, reports are prepared in accordance with the NSW Uniform Civil Procedure Rules 2005, including Schedule 7. We are available to attend court as expert witnesses, participate in joint expert conclaves, and prepare joint expert reports following conferral with opposing experts — a process increasingly required by NSW courts prior to hearing.

It can document the defects, investigate their likely causes and clearly explain the technical issues in dispute.

What should an expert engineering report for a building dispute include?

A professional expert engineering report should clearly identify the issues in dispute, document the observed defects, assess the available evidence, investigate likely causes and provide independent engineering opinions supported by technical reasoning. Depending on the matter, it may also assess relevant drawings, specifications, Australian Standards and applicable building requirements, and provide recommendations for rectification where appropriate.

Can you review another engineer's or builder's report?

Yes. We can independently review technical reports prepared by another engineer, builder, consultant or other party. We assess the technical basis, assumptions, available evidence, calculations and conclusions, and identify any matters that may require further investigation or a different engineering interpretation.

Do you need to inspect the property before preparing a report?

In many building defect matters, a site inspection is an important part of the engineering assessment because it allows the engineer to observe and document the actual condition, nature and extent of the defects. However, the need and scope of an inspection will depend on the circumstances of the matter and the information already available.

What documents should I provide to get started?

Any documents that help establish the history and technical circumstances of the matter can be useful. These may include contracts, architectural and structural drawings, previous reports, photographs and videos, correspondence with the builder, scopes of work, inspection reports, and documents from Building Commission NSW or NCAT. We will advise you if additional information is required after our initial review.

Can an engineering report help if I have already tried to resolve the issue with my builder?

Yes. Where discussions or correspondence with the builder have not resolved the matter, an independent engineering assessment can help clarify the technical facts. Rather than relying solely on the competing claims of the parties, the defects and their likely causes can be investigated and documented using engineering evidence and professional analysis.

Do you prepare engineering reports for Building Commission NSW matters?

Yes. Where a Building Commission NSW matter involves technical or engineering issues, we can investigate the building conditions and alleged defects and prepare appropriate technical documentation. The scope and level of reporting will depend on the nature of the dispute and the stage the matter has reached.

Can you determine whether a building defect was caused by defective workmanship or something else?

One of the key purposes of an engineering investigation is to identify or narrow down the likely cause of a defect. We can assess the available evidence, building conditions, construction methods and other relevant factors to determine whether an issue may be associated with workmanship, design, ground movement, water ingress, deterioration, maintenance or other causes. Our conclusions are based on the available evidence and engineering assessment.

Can your report assess whether the builder's work complies with relevant standards and requirements?

Where relevant to the matter, the completed work can be assessed against applicable drawings, specifications, contractual requirements, Australian Standards and other relevant technical or building requirements. Any opinion regarding non-compliance will be based on the requirements applicable to the particular work and the available evidence.

Do you only work for property owners, or can builders and contractors engage you as well?

Our services are not limited to one side of a dispute. Property owners, builders, contractors, legal professionals and other relevant parties may engage us for specialist engineering advice. Regardless of who appoints us, our engineering opinions remain independent, objective and based on the technical evidence.

Can you also determine the cost of repairing the defects?

Where required and within the agreed scope, the engineering assessment can first identify the defects and the appropriate remedial requirements. A scope of remedial works can then be developed, with cost estimation or other related services considered separately where appropriate. Establishing the technical cause and suitable rectification method should generally come before determining the repair cost.

How long does it take to prepare an expert engineering report?

The timeframe depends on the complexity of the matter, number and nature of the defects, volume of documentation, need for a site inspection and level of technical investigation required. Once we have reviewed the initial information and understood the required scope, we can provide an estimated timeframe for completing the assessment and report.

Can you continue supporting my matter after the report has been issued?

Yes. Our involvement does not necessarily end when the report is issued. Depending on the matter, we can provide further engineering support in relation to technical questions, new evidence, additional documentation, responses to technical issues raised by another party and other engineering matters that may arise as the dispute progresses.

How do I know whether my matter actually requires an expert engineering report?

You do not need to determine this before contacting us. You can provide an overview of the building issue together with the documents and information currently available. Following an initial review, we can advise whether the matter is more appropriately addressed through an Expert Engineering Report, Site Inspection, Technical Assessment or another form of engineering service, and what level of investigation may be appropriate for your circumstances.
